Halle Berry Denies Allegations of Child Abuse

Halle Berry refutes claims made by her former spouse Olivier Martinez that she physically harmed their 13-year-old son, Maceo, amid their impending court battle over custody and a restraining order set for Oct. 16.

Martinez is seeking exclusive legal and physical custody of Maceo and a restraining order against Berry, alleging she was aggressive towards their son during an incident on Sept. 26, as per court documents obtained by CBC News.

A temporary restraining order was granted by a Los Angeles Superior Court judge on Oct. 1, limiting Berry’s parenting time and mandating her to stay 100 yards away from Martinez until the hearing. The judge rejected Martinez’s request for monitoring Berry’s sobriety due to insufficient evidence.

Berry has refuted the accusations, labeling them as “completely untrue” and asserting that she has never mistreated Maceo in any form. She characterized the Sept. 26 event as playful roughhousing that escalated into a disagreement and is urging the court to reinstate their previous 50-50 custody agreement.

The couple, who tied the knot in 2013 and welcomed Maceo later that year, finalized their divorce in 2023 with a joint custody arrangement.

In a different development, Berry’s legal team has presented court documents challenging Martinez’s claims and highlighting past breaches of court orders and legal sanctions concerning their son’s welfare. Video evidence, according to Berry’s attorneys, contradicts Martinez’s version of events.

Berry personally filed a declaration on Oct. 5 refuting Martinez’s allegations and detailing her account of the Sept. 26 incident. She emphasized that she is not a perpetrator of violence, citing her own experience as a domestic violence survivor and advocate. Berry explained the situation as playful interaction with Maceo, denying any physical harm or restriction of his breathing.

The upcoming hearing on Oct. 16 will determine whether the temporary restrictions should persist or be altered.
