ABC and Disney Sue FCC Over License Threats

ABC has taken legal action against the Federal Communications Commission (FCC) on First Amendment grounds, accusing the agency of posing a significant threat to its operations by demanding early review of broadcast licenses. The lawsuit, filed by ABC and its parent company Disney along with eight affected local stations, seeks to halt the early renewal proceedings initiated by FCC Chairman Brendan Carr, a supporter of President Donald Trump. The FCC’s decision to review eight ABC licenses ahead of schedule was reportedly influenced by the network’s diversity practices and followed a controversial joke made by ABC’s late-night host Jimmy Kimmel, a vocal critic of Trump.

In response to what ABC describes as a pattern of attacks on its speech and content, the network alleges that the administration’s actions amount to an attempt to silence its reporting and programming. ABC argues that the FCC’s demands for license revocation based on speech content represent a direct threat to its constitutional rights, leading the network to seek relief through the judiciary.

The conflict between ABC and the FCC has been ongoing, with additional disputes arising over the treatment of ABC’s morning talk show “The View” under equal-time rules. ABC has pushed back against efforts to subject the show, known for its critical stance on Trump, to regulatory scrutiny. The network’s lawsuit highlights broader implications beyond ABC, warning of a chilling effect on media freedom if the government is allowed to dictate favorable coverage.

The lawsuit has drawn support from FCC Commissioner Anna Gomez, the sole Democrat on the commission, who commended ABC for standing up against government interference in media content. In a statement, Gomez criticized the FCC’s tactics of using license threats to control speech it disagrees with, urging other broadcasters to resist such pressures.

While FCC Chairman Carr defended the agency’s actions as upholding public interest obligations, ABC’s legal challenge underscores the network’s determination to protect its editorial independence. The FCC maintains that broadcasters, including Disney-owned entities like ABC, must adhere to public interest standards, emphasizing the ongoing examination of allegations of discrimination by Disney. The commission reaffirmed its commitment to investigating these claims and upholding regulatory requirements, despite ABC’s legal maneuvers.
