“Keir Starmer to Expand Hillsborough Law to Include Security Agencies”

Keir Starmer is set to abandon the previous proposal that exempted security agencies like MI5 from the Hillsborough law. The Prime Minister is expected to broaden the scope of the “duty of candour” introduced by the law to encompass MI5, MI6, and GCHQ. This duty mandates that public entities must be truthful and cooperate with investigations to prevent state concealment.

The “Hillsborough Law” was withdrawn from the Commons in January due to controversy surrounding an amendment concerning its application to security agencies. An amendment put forward by the government aimed to bring MI5 and MI6 operatives under the law’s jurisdiction, with approval required from their service heads. However, this provoked strong opposition from MPs, activists, and families affected by events like the Manchester Arena bombing, who demanded full inclusion of MI5 in the legislation.

According to reports from The Times, the new plans will eliminate the authority of security chiefs to prevent individual operatives from testifying. Instead, security leaders would need to seek court approval to withhold sensitive information partially or entirely.

Keir Starmer has pledged to ensure the law passes through Parliament, emphasizing the importance of public officials being truthful. He reiterated his commitment to fulfilling this promise, particularly in light of the anniversary of the Hillsborough disaster.

The 37th anniversary of the tragedy at Hillsborough Stadium, Sheffield, during an FA Cup semi-final between Liverpool and Nottingham Forest, is approaching. The campaign for the Hillsborough Law has received support from victims of other injustices, including the Grenfell Tower fire and the infected blood scandal.

Following demands from Hillsborough campaigner Margaret Aspinall to swiftly enact the law to prevent future cover-ups, progress has been made. The legislation, known as the Public Office (Accountability) Bill, will establish a legal duty of candour for all public officials, with penalties for dishonesty or information concealment.

A government spokesperson highlighted the collaborative effort with affected families to refine the Bill. The legislation aims to uphold national security while transforming the conduct of public authorities and officials during inquiries, promoting honesty and transparency in serving the public.
